The Publisher Philippe Gallardo, as data controller, attaches great importance to the protection and respect of your privacy.

The purpose of this policy is to inform you, in accordance with European Regulation No. 2016-679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as the "Regulation" or « RGPD" in French), of our practices regarding the collection, use and sharing of the information that you may provide to us in the course of our activities.

This confidentiality policy is translated in English, from the original text in French: Politique de confidentialité, only for the convenience of the non-french speaking users.

The original text in French being the reference as regard to the law in case of dispute. The French language version will have precedence and control.

When you use our website (the "Website"), during our meetings (face-to-face or remote) or when we carry out our mission with you, we may ask you to provide us with certain personal data about yourself.

By using our Website, during our meetings and the missions we carry out on your behalf, you are required to send us information, some of which is likely to identify you and therefore constitutes personal data (hereinafter referred to as the "Data"). This Data contains in particular:

•    necessary for the establishment, exercise or defense of legal claims;

- To manage our Website and perform internal technical operations in connection with problem solving, data analysis, testing, research, analysis, studies and surveys. This processing is based on our legitimate interest (to ensure the security of our Website and to improve its features).

 

When the Data is collected, you will be informed if certain Data must be filled in or if it is optional. Failure to do so may result in the non-execution of your request.

Who are the recipients of the data we collect and why do we pass this data on to them?

 

1. Data transferred to public authorities and/or bodies

 

In accordance with the regulations in force, the Data may be transmitted to the competent authorities upon request, and in particular to public bodies, court officers, ministerial officers, bodies responsible for debt collection, exclusively to meet legal obligations, as well as in the case of the search for the perpetrators of offences committed on the Internet.

 

2. Data transferred internally

 

The Data collected and processed may be transmitted to team members, assistants, interns, and to any internal department of the Company if any.

 

3. Data transferred to third parties

 

We may work in collaboration with third-party companies or consultants, self-employed entrepreneurs who may have access to your Data, and in particular with:

- The subcontractors we use to provide IT services (database management, hosting, storage, maintenance, etc.), accounting or communication services;

- Agents, consultants, or any third party involved in the support missions we offer.

 

We only provide these third parties with the Data they need to perform their services, and we require that they do not use your Data for any other purpose. These third parties will only act in accordance with our instructions and will be contractually obligated to ensure the same level of security and confidentiality of your Data as we do and to comply with applicable regulations on the protection of personal data.

 

Data retention period


Your Data will not be kept for longer than is strictly necessary for the purposes pursued as set out in this Policy, in accordance with the Regulations and applicable laws.

 

In this respect, the Data used for the purpose of carrying out the missions you entrust to us are kept for the duration of the contractual relationship, then archived in accordance with the limitation periods.

 

Your Data is deleted when the retention periods expire.

 

Archiving implies that your Data will no longer be available online but will be extracted and stored on an autonomous and secure medium.

 

The Data used for prospecting and communication purposes may be kept for a maximum period of 3 years from the end of the commercial relationship or the last contact of the prospect concerned.

 

Your Data is deleted when the retention periods expire. However, your Data may be archived beyond the periods provided for the purposes of investigating, establishing and prosecuting criminal offences for the sole purpose of allowing, as necessary, the provision of your Data to the judicial authority.

 

Archiving means that your data will no longer be searchable online but will be extracted and stored on an autonomous and secure medium.


How is your data protected?

 

All appropriate precautions and organisational and technical measures have been taken to safeguard the security, integrity and confidentiality of your personal data.

If we use a service provider, we ensure that the latter complies with its security obligations prior to the communication of your data.

 

Where is your data stored?

 

Your data is retained, stored for the duration of its processing and controlled by: Wix.com Ltd. in Israel.

Wix affiliates and Third-Party Service Providers that store or process your Personal Information on behalf of Wix are contractually committed to protecting and securing your Personal Information in accordance with industry standards and regardless of any lesser legal requirements that may apply in their jurisdiction.

 

IP may also be collected to determine the city from which you are connecting.

 

 

What are your rights over your data and how can you exercise them?

 

In accordance with the applicable laws and regulations on the protection of personal data, you have a number of rights relating to your Data, namely:

 

Right to information: you have the right to be informed about the processing of your personal data and if you would like more details, you can contact us at phgcoaching@gmail.com.

 

Right of access: You have the right to access all of your personal data at any time.

 

Right to rectification: You have the right to rectify your inaccurate, incomplete or outdated personal data at any time.

 

A right to erasure: in certain cases, you have the right to obtain the erasure of your Data. However, this is not an absolute right and we may, for legal or legitimate reasons, retain such Data.

 

Right to restriction: You have the right to obtain the restriction of the processing of your personal data in certain cases defined in Article 18 of the GDPR.

 

Right to portability: you have the right to receive your personal data in a readable format and to request its transfer to the recipient of your choice.

 

Right to be forgotten: You have the right to demand that your personal data be erased, and to prohibit any future collection of your personal data.

 

Right to lodge a complaint: with the CNIL in France, if you consider that the processing of your personal data constitutes a violation of the applicable texts.

The right to withdraw your consent at any time: You may withdraw your consent to the processing of your Data where the processing is based on your consent. The withdrawal of consent does not affect the lawfulness of the processing based on the consent carried out before such withdrawal.

 

The right to give instructions regarding the fate of your data after your death: You have the right to give us instructions regarding the use of your Data after your death.
